1. Terms and conditions

Terms and conditions apply to Guests and all members of their party (including day visitors). It is the Guests’ responsibility to ensure that each member of their party is aware of and accepts the Terms and Conditions and the obligations contained therein.
The Owners reserve the right to cancel a booking without compensation or refund should Guests not comply with any of the Terms and Conditions outlined below.

2. Arrival and Departure

A standard booking is from Friday through to Friday, although short breaks are often available. In order to prepare the cabins between Guests, we ask that you arrive after 3.00pm and leave by 10.00am on your departure date. Occasionally extensions to departure time can be accommodated by prior arrangement.

3. Bookings/Payment

All bookings must be made by people aged 18 years or over. Initially bookings will be provisional via our online reservation system. No booking is confirmed until a non-refundable deposit of 25% of the cost of rental per barn per week has been received.
When you submit a booking via the online reservation system you will receive an automatically generated booking summary by e-mail to the e-mail address you provide on the booking form. This does not form a contract between us. A contract shall only arise when your booking is subsequently confirmed by email and deposit payment received.
All payments must be completed by cheques within 7 days or via our online reservation system. Please note there will be a charge for credit card transactions, on a percentage basis, but no charge for debit card transactions.
The remaining balance payment will be due 6 weeks before the holiday date. Please note you may lose your booking and deposit if the full balance is not received as stated. For late bookings (within 6 weeks of holiday date) payment is required in full at the time of booking.
The price includes all heating, electricity, bed linen, bath and hand towels, tea towels, basic cleaning materials, washing up liquid, dishwasher tablets and some additional facilities (see section 6 below). The barns will also be cleaned before you arrive and after you leave but we ask you to leave the barns in good order or additional cleaning will be charged for.pri

4. Cancellations

If you have to cancel please inform us immediately and we will endeavour to re-let the barn and return your balance payment in full, (your initial deposit is non refundable). If re-letting is not possible, all monies which have been paid will be forfeited. In the event of Guests being unable to travel to Tir-Cethin due to severe weather conditions a refund will not be given, therefore, a CANCELLATION PROTECTION INSURANCE IS RECOMMENDED. You may not under any circumstances transfer your booking to anyone else without our prior consent.
Following your booking, in the unlikely event of your accommodation becoming unavailable due to circumstances outside our control, every effort will be made to provide an alternative barn at Tir-Cethin or nearby self-catering accommodation of the same standard, or alternatively a complete refund will be paid including the deposit.
The Owners do not accept responsibility for breakdown in public or local supplies, including water or electricity, nor any claims against inconvenience caused by such incidences, or by building works that may be deemed as necessary. In the case of any breakdown Guests are asked to notify the Owners immediately. We will endeavour our best, in conjunction with the service company concerned, to correct the fault as soon as possible.
In the event of a national or local disease epidemic, whether human or animal, the Owners reserve the right to cancel any booking at any time. In such cases a full refund will be given.
The Owners retain the right to refuse to hand over the barn to a Guest, or repossess holiday accommodation if it is reasonably believed that any damage is likely to be caused, or can repossess the cabin if damage has already been caused. No refunds will be given in these circumstances.
Tir-Cethin is an idyllic rural environment so all noise needs to be kept to a minimum epically between 10pm and 8am.
Any complaints must be made known to the Owners immediately. No complaints will be entertained after the end of the hiring period or after the Guest has departed.

5. Safety

Tir-Cethin Farm has a no smoking policy in all of the accommodation. Smoking is prohibited in and around the farmyard and barns. Guests may not bring any personal shotgun or firearm to Tir-Cethin under any circumstances or for any reason whatsoever.
Please ensure that children are not allowed to wander around the farm unsupervised. Tir-Cethin is a farm in a rural environment and can be very dangerous. Any animals found roaming around the farm should be left alone and not fed, as this will attract other larger predators.
The use of any play equipment at Tir-Cethin is entirely at the guests own risk. We shall accept no liability for accidents whilst using any play equipment. Children should be supervised at all times.
For personal safety it is especially important that children do not go near the shallow pond.
Barns are fitted with log burning stoves. Fire guards can be provided but DO NOT provide total safety from accidents. Therefore if you have children it is advisable not to light the stoves. The safety gloves and tools must be used at all times when using the stove. Instructions for the use of the stove can be found in the information folder provided. The owners do not accept any liability for any injury caused while using the stove.
Guests may be asked to leave immediately if their conduct is considered to infringe the Owners’ Terms and Conditions/rules or is likely to impair the enjoyment, comfort or safety of other guests and/or staff. No refunds will be given in these circumstances.

If Guests or any member of their party has or has just had an infectious or contagious medical condition the Owners have the right to refuse to accept the booking, cancel the holiday or ask the Guest to leave Tir-Cethin immediately should it be considered necessary, to protect the health of other guests and/or staff. The Owners should be informed immediately should any condition develop within four weeks of arrival date, or during the holiday at Tir-Cethin.

5. Safety

6. Additional Facilities

Travel Cots, Highchairs, microwaves sterilisers are available at no extra cost but must be requested during booking.DIY livery is available free of charge in one of the Farms fields. We shall accept no liability for accidents caused to the horse whilst using the fields. Livery in a stable can be organised in a local livery yard where your horse can be kept in a stable, food is also available to purchase at the yard. These options cannot be guaranteed, must be requested during booking and we will check on availability, costs and contact you.

7. General

The number of persons occupying the cabins must not exceed that stated at the time of booking, unless agreed previously with the Owners. Sub-letting of the cabins is strictly prohibited.
The Owners cannot accept responsibility or liability for loss or damage to Guests’ property, or for personal injury, or damage to bicycles, cars or horseboxes/trailers parked at Guests’ risk.
The Owners reserve the right to have access to the barns at all reasonable times, with prior notice whenever possible.
The Owners endeavour to maintain high standards of comfort and cleanliness at all times. The Guest must therefore undertake to keep all furniture, fittings and effects in the same good condition as they were found. If extra cleaning is required after departure it will be charged to the Guest.
All damage must be reported to the Owners as soon as possible. Accidental damage or breakage of a minor nature will not normally be charged for, but the Owners reserve the right to charge for any non-trivial damage, losses or additional cleaning required howsoever caused. Immediate payment from the Guest is required to cover any such costs.
No medical facilities are available on site.
Mobile phone reception is variable depending on the service provider. In emergency there is a phone available in the farmhouse.

8. Wi-Fi

Wi-Fi is usually available, but not 100% guaranteed. As in many rural areas the broadband speed is very slow, therefore please keep usage to minimum.
By accepting these terms and conditions those using Wi-Fi agree to the Tir-Cethin Farm Public Wi-Fi Access Terms & Conditions.

Tir-Cethin Farm Luxury Barn Holidays Public Wi-Fi Access Terms and Conditions

This agreement sets out the terms and conditions on which wireless internet access (“the
Service”) is provided free of charge to you, a guest of Tir-Cethin Farm Luxury Barn Holidays (“us”) in
consideration for your custom, your agreement to these terms and conditions and your
agreement to allow us to send to you by e-mail our promotional and marketing material.

8.1. Extent of the Service

8.1.1 We do not recommend in particular the use of any websites (or other internet related
services) (“Internet Services”) and your use of Internet Services is carried out entirely at
your own risk.

8.1.2 We have no responsibility for, or control over, the Internet Services you access and do
not guarantee that any services are error or virus free.

8.1.3 We have no responsibility for, or control over, the information you transmit or receive via
the Service.

8.1.4 Save for the purposes of network diagnostics we do not examine the use to which you
put the Service or the nature of the information you send or receive.2

8.1.5 We do not guarantee:

8.1.5.1 the availability of the Service;
8.1.5.2 the speed at which information may be transmitted or received via the Service; or
8.1.5.3 that the Service will be compatible with your equipment or any software which you
use.

8.1.6 Whilst we take reasonable steps to ensure the security of the Service and to prevent
unlawful access to information transmitted or received using the Service we do not
guarantee the security of the information which you may transmit or receive using the
Service or located on any equipment utilizing the Service and you accept that it is your
Responsibility to protect your information and have adequate security (in terms of
equipment and procedures) to ensure the security, integrity and confidentiality of your
information and data.

8.1.7 We reserve the right at all times to withdraw the Service, change the specifications or
manner of use of the Service, to change access codes, usernames, passwords or other
security information necessary to access the service.

8.2. Your Use of the Service

8.2.1 You must not use the Service to access Internet Services, or send or receive e-mails,
which:
8.2.1.1 are defamatory, threatening, intimidatory or which could be classed as
harassment;
8.2.1.2 contain obscene, profane or abusive language or material;

8.2.1.3 contain pornographic material (that is text, pictures, films, video clips of a sexually
explicit or arousing nature);
8.2.1.4 contain offensive or derogatory images regarding sex, race, religion, colour,
origin, age, physical or mental disability, medical condition or sexual orientation;
8.2.1.5 contain material which infringe third party’s rights (including intellectual property
rights);
8.2.1.6 in our reasonable opinion may adversely affect the manner in which we carry out
our business; or
8.2.1.7 are otherwise unlawful or inappropriate;

8.2.2 Music, video, pictures, text and other content on the internet are copyright works and you
should not download, alter, e-mail or otherwise use such content unless certain that the
owner of such works has authorized its use by you.

8.2.3 We may terminate or temporarily suspend the Service if we reasonably believe that you
are in breach of any provisions of this agreement including but not limited to clauses 8.2.1
to 8.2.3 above.

8.2.4 We recommend that you do not use the service to transmit or receive any confidential
information or data and should you choose to do so you do so at your own risk.

8.2.5 The Service is intended for consumer use only. In the event that you use the Service for
commercial purposes we would specifically refer you to clause 8.5.2 below.

8.3. Criminal Activity

8.3.1 You must not use the Service to engage in any activity which constitutes or is capable of
constituting a criminal offence, either in the United Kingdom or in any state throughout
the world.

8.3.2 You agree and acknowledge that we may be required to provide assistance and
information to law enforcement, governmental agencies and other authorities.

8.3.3 You agree and acknowledge that we may keep a log of the Internet Protocol (“IP”)
addresses of any devices which access the Service, the times when they have accessed
the Service and the activity associated with that IP address

8.3.4 You further agree we are entitled to co-operate with law enforcement authorities and
rights-holders in the investigation of any suspected or alleged illegal activity by you which
may include, but is not limited to, disclosure of such information as we have (whether
pursuant to clause 8.3.3 or otherwise), and are entitled to provide by law, to law
enforcement authorities or rights-holders.

8.4. Our Use of your Information

8.4.1 Subject to clauses 8.3.3 and 8.3.4 above we confirm that we shall use the contact details you
provide to us solely for the purposes of contacting you with marketing information,
updates, promotions and special offers relating to our business.

It is important to ensure that this clause is complied with (or amended depending on how the data is used) and Data you collect is processed in accordance with the Data Protection Act and any mailings comply with the Privacy and Electronic Communications (EC Directive) Regulations 2003

8.5. Other Terms

8.5.1 You agree to compensate us fully for any claims or legal action made or threatened
against us by someone else because you have used the service in breach of these terms
and conditions, and in particular clause 8.2.1 to 8.2.3 and 8.3.1 above.

8.5.2 Whilst we do not seek to limit our responsibility for fraudulent misrepresentation or if you
are injured or die as a result of our negligence we have no responsibility (to the extent
permitted by law) to compensate you (whether or not we are negligent) for any direct
financial loss, loss of profit, revenue, time, anticipated savings or profit or revenue,
opportunity, data, use, business, wasted expenditure, business interruption, loss arising
from disclosure of confidential information, loss arising from or in connection with use of
the service or inability to use or access the service or a failure, suspension or withdrawal
of all or part of the service at any time or damage to physical property or for any other
similar direct loss that may arise in relation to this agreement whether or not we were
advised in advance of the possibility of such loss or damage.

8.5.3 We agree that neither this agreement does not allow either party to act as, or hold
themselves out as, acting as an agent of the other party and that that the terms of this
agreement are not enforceable by a third party under the Contracts (Rights of Third
Parties) Act 1999.

8.5.4 This agreement is governed by the law of England and Wales and is subject to the non-
exclusive jurisdiction of the English courts.

Please note that we do not subscribe to unlimited downloads and therefore operate a ‘fair usage policy’. This should be more than enough to keep in touch with the office or home via email and for regular web browsing.
Heavy usage of the internet such as downloading music & films, watching programmes on BBC iPlayer or using the telephone over the internet (VOIP) may not be covered by the data allowance and may be chargeable.

Wi-Fi Broadband is available free of charge but is subject to the following restrictions:
• You agree to abide by the ‘fair usage policy’.
• You agree to use the internet responsibly and not to access illegal or offensive websites. Parents are responsible for supervising their children’s use of the internet.
• You agree to pay for data usage over and above the fair usage limit (roughly 2.5 gb per week) at a rate of £3 per gigabyte. This will be deducted from the security deposit.
Details of how to connect to the internet will be made available on arrival.

9. Pets

We regret that in the interest of future Guests pets are not allowed in the barns.
